Disciplinary Process

The S4K Disciplinary Process is comprehensive and in line with the ACAS code of conduct for employers.

As a brief outline, it includes:

1. Investigation:  Evidence should be gathered on the potential breach of the disciplinary policy.  This evidence should include the specific data points on the breaches (e.g. instances of lateness) as well as artefacts where possible (e.g. text messages, emails).

2. Notification:  The Team Member should be notified of the Disciplinary Action by telephone, providing a brief outline of the reasons for the meeting invitation.

3. Letter of Invitation:  A letter of invitation to the disciplinary meeting should be issued, with a meeting date and time set for no sooner than 48 hours from the moment of informing.  These 48 hours must be in line with the employees normal working time (e.g. a meeting arranged on a Friday at 2pm would need to take place on the following Wednesday if the employee does not work at the weekend).

4. Evidence:  The letter of invitation should include all evidence to be discussed in the meeting and the specific breaches of the disciplinary policy.

5.  Meeting:  The meeting should take place with two members of the Sport4Kids team – one as the Meeting Leader and the other as Note Taker.  The employee can bring a colleague or member of trade union with them to the meeting if they wish.

6.  Discussion: The alleged breaches are discussed and the employee is given the opportunity to respond to each in turn (their responses should all be documented).

7. Deliberation:  Once the meeting has concluded, the Sport4Kids team review the evidence and decide on the most appropriate next steps while the employee leaves the room. In rare cases, this process can be extended to 24-48 hours.

8. Verdict:  The employee is invited back into the room and SMART targets are agreed to prevent future instances of disciplinary breaches.

9. Notes:  Notes from the disciplinary are typed up and signed by the employee once they have reviewed. These are stored on their HR file.

10. Outcome Letter:  This is sent to the individual, detailing the outcome of the Disciplinary Hearing.
